Rental Agreement & Cancellation Policy

We must have a signed Rental Agreement before securing the Reservation, this is an overview of it.

Minimum Age Requirement

Occupant signing and entering into agreement of Terms & Conditions must be of 25 years or older.

Security Deposit

Your Credit Card above given to the Agent (Tahoe Signature Properties – Property Owner’s designated agent hereinafter referred to as “Agent”), in trust, as security deposit for the performance by the Tenants of the terms of this rental agreement set forth following, and for any excessive cleaning and maintenance, besides accidental damages that will be covered by the Damage Insurance, caused by Tenants, Tenants’ family and visitors (hereinafter collectively called “Tenants”) to the premises or furnishings during the rental period. Agent may use part or all of the security deposit to arrange repairs or excessive cleaning to the Unit caused by Tenants. However, Agent is not limited to just the security deposit portion of any security deposit amount and Tenants remain liable for any balance.

Key Charge

A $25.00 fee will be charged to Tenants for failure to return any and all Unit related keys and/or gate access cards* (*if applicable). Such charge shall be deducted from the security deposit or charged to the credit card on file. A $50.00 fee will be charged for Tahoe Donner Passes not returned back to the Unit after tenants departure.

Cleaning

Tenants shall leave the Property in reasonably clean conditions, including emptying of all trash cans during occupancy of the property and loading and starting the dishwasher. Upon departure, please do not make up beds that have been used. If Tenant wishes to obtain daily housekeeping service, please advise Agent in advance so it may be arranged for a fee. If /when at departure the property will be in need of a more extensive cleaning or carpet cleaning the funds will be charged to the credit card on file and you’ll be supplied with a receipt.

Pets

There is a pet fee of $100.00, only applied to Pet Friendly Homes, the tenant must notify the company when planning on bringing a pet, if/when cleaners find traces of a pet after departure the tenant will be liable for the pet fee and such fee will be charged to the credit card on file. When tenant brings a pet to a Pet Free home, the carpets and upholstery will be cleaned, this extra cleaning will be charged to the credit card on file. There are absolutely no pets allowed at any of the Sweetbriar properties, this is a pet free complex, violators will be asked to leave causing the breach of the contract.

Damage Protection

Accidental Damages only will be covered by the Damage Protection (when purchased) and it covers up to $3000.00 worth of damages. Any other damages to the property or accidental damages that exceed $3000.00 shall be assessed to the deposit or credit card used to hold the reservation. Accidental Damage Waiver Does Not Cover: Intentional acts of a guest and traveling companions; Gross negligence or willful conduct; Any loss, if a guest or traveling companions do not take reasonable and prudent measures to protect the residence; Any loss, if the guest does not report the damage to Tahoe Signature Properties staff by the time of vacating the residence; Normal wear and tear; Theft without forced entry; Damage or loss caused by any pet or another animal that was not allowed onto the premises under the Rental Agreement.

Maximum Occupancy

At no time should the number of Tenants occupying the Unit exceed the units Maximum Occupancy listed on the website. Any extra guests will be asked to vacate the premises immediately and a fine of $50/each per extra person per night will be charged to you. Use of Decks/Balconies: At no time should there be more people on the Units deck then what the Unit’s Maximum Occupancy is, having more than maximum allowed number people will be done at your own risk and the Agent and Owner will be released of any liability.

Reservation Fee and Payments

For reservations made 30 days and less before arrival, 100% of reservation is due in order for the reservation to be confirmed. If this Rental Agreement is entered into more than 30 days before arrival, 25% is due immediately upon execution of this Rental Agreement, once paid, the reservation fee is for services rendered in entering into this Rental Agreement and is NON-REFUNDABLE. The balance of the rent and other charges specified above is due 30 days before arrival.

Cancellation Policy

Should Tenant cancel the reservation after Agent confirms this Rental Agreement, and before 30 days of arrival date,Tenant will receive a refund of the full contractual amount.
Should Tenant cancel the reservation after Agent confirms this Rental Agreement, within 30 days before arrival date,Agent will attempt to rebook the Unit at the same rate. If Agent is able to rebook the Unit at the same rate, Tenant will receive a refund of the full contractual amount less 25% reservation fee. If Agent is able to rebook the Unit at a lower rate, Tenant will receive a refund in the amount of the lower rate less 25% reservation fee. If Agent is unable to rebook the Unit, Tenant’s full payment, excluding taxes and cleaning fee, will be not refunded.
There shall be no refund or credit provided in the event the Tenant is unable to arrive at the Unit on the arrival date or in the event Tenant departs from the Unit prior to the departure date for the following reasons, including but not limited to: road closure, inclement weather, health problems, fires in the basins which do not require evacuation, or disruption of utility services.
To protect against cancellations caused by certain unforeseen events, such as illness, death, natural disasters, etc., we recommend that guests purchase trip cancellation and Interruption Protection insurance to assure refund of deposits paid and reimbursement of other vacation payments. Check-In


Check-in time is 4 PM on the day Tenant’s scheduled reservation begins. No early check-ins absent prior consent of Agent. A day before your arrival an email will be sent to the Tenant with check-in instructions, Tenants will be given their key(s) and gate access card(s) (if needed), as well as any special instructions or updates that may be applicable to the Unit.

Check-Out

Check-out time is 10 AM on the day Tenant’s scheduled reservation ends. Any delay in check-out, absent prior consent of Agent shall result in Tenants being charged for another night’s stay.

Use of Premises

Tenants shall only use the Premises as a residence. The premises shall not be used for any unlawful purposes. Tenants will comply with all laws, rules, ordinances, statutes and orders regarding the use of the premises.

Quiet Enjoyment

Tenants shall be entitled to the quiet enjoyment of the premises, and Agent will not interfere with that right, as long as tenants do not interfere with those rights of neighbors or other tenants. Loud music, noise, parties, large groups, events and inadequate conduct will result in a call to the police department.

Smoking

No smoking is allowed on the premises; such action is a breach of this rental agreement and will result in carpet and upholstery cleaning, such extra cleaning will be charged to the credit card on file and tenant will be supplied with a receipt, please refrain from smoking inside the house.

Wi-fi

While all of our Premises have internet, we can not guarantee that you will have it throughout your entire stay. Due to the weather, we have the internet go down often. The Agent will, however, do the best to get the service back ASAP.

Use of Grills

Grilling is permitted only in the area where the BBQ is located. Please do not move the BBQ from it’s designated place.

Locked Areas

Areas that are locked, such as Owner’s personal storage spaces, for which Tenants are not provided a key, are off limits to the Tenants. Any attempt to enter locked areas is cause for immediate termination of this agreement, forfeiture of all monies paid, and Tenants will be liable for any damage and/or missing items.

Agent Entry

The Agent reserves the right to access the premises during tenant’s occupancy when there is a breach of the rental agreement such as unlawful activity, neighbors disturbance, smoking, exceeding the maximum occupancy, etc.

Hot Tubs (when applicable)

For your protection and safety, please read these rules and precautions before using the hot tub.When using this hot tub, basic safety precautions should always be observed, including the following: Do Not permit any electrical appliance, such as a light, telephone, radio, or TV within five feet of the hot tub. Do not permit children under the age of 14 to use this hot tub unless they are closely supervised at all times. In no case should children under 8 years old be permitted in the hot tub. Do not drink alcoholic beverages before or during hot tub use. Pregnant women and people under medical care (for such problems as heart disease, diabetes, blood pressure, circulatory problems, or obesity) must consult their physician prior to using the hot tub. Some medications can induce drowsiness. Never use the hot tub when taking anticoagulants, antihistamines, vasoconstrictors, vasodilator, stimulants, hypnotics, narcotics, or tranquilizers. In all cases, if you are not thoroughly familiar with the medication you are taking, check with your doctor prior to using the hot tub. People with skin, ear, genital or other body infections, skin sores, or open wounds are not allowed to use the hot tub. It is recommended that people shower before and after using hot tub. Many skin and hair care products can adversely affect the chemical balance of the water. The tub is professionally cleaned. Never add any chemicals. Always use caution when entering and exiting the hot tub. Wet surfaces can be slippery. Long hair should be restrained in a bathing cap or other restraining device. Never allow long hair to float in the hot tub. Suction through drains and skimmers can be powerful, especially to small children and adults with long hair. Never walk, climb, play, or jump on the cover of the hot tub. Never swim or play under the cover when it is installed on the hot tub. Also, do not rely on the cover as a way of keeping children out of the hot tub. Children must be supervised when they are in or around the hot tub. Soaking for too long at high water temperatures can elevate body temperature and temperature of internal organs beyond safe limits. No diving or jumping into the hot tub. When the hot tub is not in use, the cover must be reinstalled in proper position and secured. The hot tub should never be turned off. This can interfere with maintaining the cleanliness and temperature of the unit. If cleaning is required due to negligence or abuse, you will be required to pay for the cleaning and/or other repairs. Tahoe Signature Properties and the owners of the house you are renting accept no responsibility for the use of this hot tub by anyone renting this house and their guests. I have read the above rules and precautions, understand them and agree to them.

HOLD HARMLESS

The agent attempts to maintain the Units in the best of the condition. Agent expresses no guarantees, express or implied, regarding the suitability or fit ability for any particular purpose. Agent does guarantee that appropriate repair and/or replacement will be performed as soon as possible under prevailing circumstances. It is Tenant’s responsibility to immediately notify Agent of any issues that they incur during their stay so that the repair and/or replacement may be promptly taken care of. Agent is not responsible for any inconveniences for which Agent has no immediate control. These inconveniences may include, but are not limited to, the following: (i) breakdown of VCR’s, hot tubs, saunas, and/or other recreational appliances or devices; (ii) power outages; (iii) adverse weather and/or road conditions; (iv) construction in the area; and (v) Units that are not decorated and/or accommodated to Tenant’s individual tastes. Agent shall not be held liable, or otherwise take any responsibility, for any injuries that may occur to Tenant, and/or Tenant’s invitee, that is caused or permitted to be caused by the intentional, unintentional, negligent, or careless acts of said Tenants, and/or invitees. Agent holds the right to relocate the tenant to a comparable Unit (or help find a suitable Unit) if/when the property booked in the first place becomes unavailable. By the written or electronic endorsement of this Agreement, Tenant agrees to forever hold harmless and indemnify Agent from any liability and/or responsibility arising therefrom.

ENTIRE AGREEMENT. THIS AGREEMENT COMBINED WITH ANY AND ALL COMMUNITY RULES AND REGULATIONS (IF APPLICABLE) SERVES AS THE ENTIRE AGREEMENT. NO ADDITIONAL PROVISIONS ARE EXPRESSED NOR IMPLIED. THIS AGREEMENT SUPERSEDES ANY AND ALL-PREVIOUS ORAL AND/OR WRITTEN, EXPRESS AND/OR IMPLIED AGREEMENTS. UPON WRITTEN OR ELECTRONIC ENDORSEMENT, TENANTS AGREE THAT THEY HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND ACCEPT ALL TERMS, CONDITIONS, COVENANTS AND RESTRICTIONS, WITHOUT EXCEPTION.
